Terms and Conditions

Vilankulo Connect

Important: This document was drafted with AI assistance as a structural starting point and has not yet been reviewed by a qualified Mozambican lawyer. It should not be relied upon as final or legally binding advice.

1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern access to and use of the Vilankulo Connect website and progressive web app (the "Site"), operated by:

[Legal name of the operating entity, e.g. "SaltLine Networks, Lda." — to be confirmed]

("Operator", "we", "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. Separate provisions apply depending on whether you are a general visitor ("User") or a business paying to be listed on the Site ("Advertiser").

2. Definitions

3. Description of the Service

The Site is an online directory of restaurants, bars, activities, and services in and around Vilanculos, Mozambique, together with a calendar of one-off special events. The Site facilitates contact between Users and Advertisers (for example, via WhatsApp, phone call, or driving directions) but is not itself a party to any transaction, booking, reservation, or purchase that results from that contact. The Operator does not process payments between Users and Advertisers, does not guarantee the accuracy of any Listing at the time a User views it, and does not guarantee that any Advertiser will honour a request made through the Site.

4. Eligibility

The Site is intended for use by individuals who have reached the age of majority under Mozambican law, or who are using the Site under the supervision of a parent or guardian. By using the Site, you represent that you meet this requirement.

User Terms

5. Acceptable Use

When using the Site, you agree not to:

6. No Warranty on Listing Accuracy

Listings, opening hours, prices, phone numbers, and event details are supplied by Advertisers themselves and may change without notice. The Operator makes reasonable efforts to encourage accurate, current information but does not independently verify each Listing and gives no warranty that any Listing is accurate, complete, or up to date at the moment a User relies on it. Users should confirm important details (such as whether a venue is actually open, or an event is still happening) directly with the Advertiser before travelling.

7. Third-Party Transactions

Any booking, reservation, purchase, or arrangement a User makes with an Advertiser — including via the Site's "Request booking" WhatsApp feature — is a private arrangement solely between the User and that Advertiser. The Operator is not a party to it, does not guarantee its outcome, and is not responsible for any dispute, loss, injury, or dissatisfaction arising from it. Directions, distances, and travel estimates shown on the Site are provided by third-party mapping services and are estimates only.

8. Local Device Storage

The Site may store limited information directly on a User's own device (not on the Operator's servers) to remember language preference, a personal shortlist of favourited venues, and whether certain introductory messages have already been shown. This local storage is described further in the accompanying Privacy Policy.

Advertiser Terms

9. Application and Eligibility

To be listed as an Advertiser, a business must operate lawfully in Mozambique and provide accurate information about itself. The Operator may decline any application at its discretion, including where a business cannot be verified, operates unlawfully, or is deemed unsuitable for the Site's audience.

10. Fees and Payment

[Insert the actual fee structure — listing price, billing frequency, accepted payment methods, currency (MZN), and whether prices include VAT/IVA under Mozambican tax law. A lawyer or accountant familiar with Mozambican tax obligations should confirm the VAT treatment specifically.]

Unless stated otherwise at the time of purchase, fees are quoted and payable in Mozambican Metical (MZN) and cover the listing period agreed with the Operator at the time of sign-up.

11. Content Standards

Advertisers are solely responsible for the accuracy and legality of the Content they submit, including descriptions, prices, photographs, and menu or price-list links. Advertisers confirm that they own or have the right to use any photo, logo, or text they submit, and that their Content does not infringe any third party's intellectual property or contain false, misleading, or unlawful claims. The Operator reserves the right to edit Listing formatting for consistency with the Site's design, and to refuse or remove Content that breaches these Terms.

12. Listing Duration, Renewal, and Cancellation

[Insert the actual listing term, renewal process (automatic vs. opt-in), notice period for cancellation, and refund policy for early cancellation — this is a business decision the Operator needs to make, disclosed clearly to Advertisers before payment.]

13. No Guarantee of Results

The Operator does not guarantee any specific level of traffic, enquiries, bookings, or revenue as a result of a Listing. Figures shown in the Advertiser's own admin statistics (page views, clicks, booking requests) are provided for informational purposes and reflect activity on the Site only, not confirmed outcomes.

14. Right to Refuse or Remove

The Operator may suspend or remove any Listing at any time, with or without notice, where the Operator reasonably believes the Listing breaches these Terms, is inaccurate, brings the Site into disrepute, or where the Advertiser's account falls into arrears on any fee due. Removal for cause under this clause does not entitle the Advertiser to a refund of fees already paid, except where required by Mozambican consumer protection law.

General Provisions

15. Intellectual Property

The Site's own design, branding, logo, source code, and original written content belong to the Operator. Advertisers retain ownership of the Content they submit but grant the Operator a non-exclusive licence to display it on the Site (and in any promotional material for the Site) for the duration of the Listing.

16. Disclaimers

The Site, including its weather forecasts, distance calculations, and directions, is provided "as is" without warranties of any kind, to the fullest extent permitted by Mozambican law. Weather data is sourced from a third-party service and is an estimate, not a guarantee. The Operator does not warrant that the Site will be uninterrupted, error-free, or available at all times, including during connectivity outages that the Site's offline mode is designed to partially mitigate but cannot eliminate entirely.

17. Limitation of Liability

To the fullest extent permitted by Mozambican law, the Operator's total liability to any User or Advertiser arising from use of the Site shall not exceed the total fees paid by that Advertiser to the Operator in the twelve (12) months preceding the claim (or, for Users, shall be limited to zero, as the Site is provided to Users free of charge). Nothing in these Terms excludes liability that cannot lawfully be excluded under Mozambican law, including for death or personal injury caused by proven negligence, or for fraud.

18. Indemnification

Advertisers agree to indemnify and hold the Operator harmless from any claim, loss, or expense (including reasonable legal fees) arising from the Advertiser's Content, the Advertiser's breach of these Terms, or any dispute between the Advertiser and a User.

19. Termination

The Operator may suspend or terminate a User's access to the Site, or an Advertiser's Listing, at any time for breach of these Terms. Advertisers may cancel their Listing in accordance with Section 12 above.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Mozambique. Any dispute arising from these Terms or use of the Site shall first be addressed through good-faith direct negotiation between the parties and, failing resolution, shall be subject to the exclusive jurisdiction of the competent courts of Mozambique.

[Confirm with a Mozambican lawyer whether a specific judicial district/comarca should be named, and whether arbitration is preferred over the ordinary courts for commercial disputes with Advertisers.]

21. Changes to These Terms

The Operator may update these Terms from time to time. Material changes affecting Advertisers' paid rights will be notified with reasonable advance notice. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

22. Miscellaneous

If any provision of these Terms is found unenforceable under Mozambican law, the remaining provisions continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between a User or Advertiser and the Operator regarding use of the Site. Neither party is liable for delay or failure to perform caused by events beyond their reasonable control.

23. Contact
